MEMBER TERMS AND CONDITIONS

These Member Terms and Conditions (this “Agreement”) apply to all users (“you” or “Member”) who access, register for, or use the Psycora website at https://psycora.co and associated intuitive guidance platform services (collectively, the “Service”).

By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms, you must not access or use the Service.

1. What is Psycora?

Psycora operates an online digital platform that enables Members to browse, locate, communicate with, and purchase real-time guidance sessions or advisory consultations directly from independent third-party advisors (“Advisors”). Psycora acts solely as a technology marketplace connecting Members with independent Advisors.

2. Nature of Guidance & Disclaimer

  • Independent Contractors: Advisors on Psycora are independent practitioners and are neither employees, agents, nor direct legal representatives of Psycora. Psycora does not directly supervise, control, or guarantee the exact accuracy, style, or specific results of an individual advisor's reading.
  • Informational & Reflection Purposes: Consultations, insights, responses, and materials provided through the Service are offered for guidance, self-reflection, and personal exploration purposes.
  • No Substitute for Professional Medical, Legal, or Financial Care: Information provided by any Advisor is not a substitute for in-person medical diagnosis, mental health therapy, financial accounting, or certified legal counsel. Members must never make critical medical, financial, or legal decisions based solely on platform consultations.
  • Emergency Situations: If you are experiencing a mental health crisis, contemplating self-harm, or facing an immediate medical or personal emergency, please disconnect and contact your local emergency services (such as 911 or local emergency hotlines) immediately.

3. Acceptable Use & User Conduct

By using Psycora, you represent, warrant, and agree that:

  • Age Requirement: You are at least 18 years of age. Psycora strictly prohibits access or account creation by minors.
  • Account Accuracy: All information submitted during registration is true, accurate, and kept updated.
  • Account Confidentiality: You are responsible for maintaining the confidentiality of your account credentials (email and password) and for all activity occurring under your account.
  • Community Conduct: You will not stalk, harass, abuse, threaten, or violate the personal boundaries or privacy rights of any Advisor or fellow Member.
  • System Integrity: You will not introduce malicious code, viruses, automated scrapers, or interfere with platform servers, network security, or the rating and review system.
  • No Platform Circumvention: You agree not to solicit or arrange off-platform consultations or unapproved payment methods with Advisors discovered via Psycora.

4. Fees, Balances & Payment Processing

  • Billing & Authorized Charges: All consultations and messaging sessions are billed through Psycora's secure billing system. You agree to pay the rates displayed and confirmed prior to starting a session.
  • Payment Security: Payments are handled through encrypted, certified third-party payment gateways (e.g., Stripe, PayPal). You authorize Psycora to charge your chosen payment method for all authorized session fees or credit purchases.
  • Time Increments: Per-minute sessions are calculated based on server time logs, rounded to the nearest minute increment.
  • Refund Requests: If you experience an exceptional technical failure or billing discrepancy during a consultation, refund inquiries must be submitted to support@psycora.co within seven (7) days of the completed session for review.

5. Intellectual Property Rights

All software, visual interfaces, website copy, graphics, branding, logos, and proprietary features on Psycora are the exclusive intellectual property of Psycora and protected by international copyright, trademark, and intellectual property laws. You may not copy, scrape, distribute, reproduce, or create derivative works from platform assets without prior express written consent.

6. Termination of Access

Psycora reserves the right, in its sole discretion and without prior liability, to suspend, terminate, or restrict account access for any Member who violates these Terms, engages in fraudulent behavior, abuses advisory personnel, or attempts to compromise platform security.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PSYCORA, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR PERSONAL EMOTIONAL DISQUIET) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR THE SESSIONS PROVIDED BY INDEPENDENT ADVISORS.

IN ALL CIRCUMSTANCES, PSYCORA’S AGGREGATE LIABILITY ARISING WITH RESPECT TO ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU TO PSYCORA IN THE ONE (1) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to defend, indemnify, and hold harmless Psycora, its officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the platform, or violation of applicable laws.

9. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with applicable governing jurisdiction laws, without regard to conflict of law principles. Any dispute or claim arising out of or relating to these Terms or platform usage shall be resolved through good-faith negotiations or binding individual arbitration, waiving rights to class-action litigation where legally permissible.

10. Modifications to Terms

Psycora reserves the right to amend or update these Member Terms and Conditions at any time. Material updates will be indicated by the revised "Effective Date" at the top of this document. Continued use of the platform following the posting of modifications constitutes your acceptance of the revised Terms.
